The petitioner seeks bail in anticipation of his arrest in connection with Harsidhi P.S. Case No. 134 of 2019 instituted for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
From the F.I.R., it appears that 15 litres of liquor was recovered from the house of one Rudal Sahani. The police party was informed that the two persons who had fled away at the time of raid were Rudal Sahani and the petitioner.
Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.36088 of 2020(2) dt.06-04-2021 2/2 that the recovery is from the house of Rudal Sahani with whom the petitioner has got no concern. He has been made accused in this case only on the basis of disclosure made by the villagers before the police party.
The petitioner does not have criminal antecedents. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge, Excise, East Champaran, Motihari, in connection with Harsidhi P.S. Case No. 134 of 2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
