This application for grant of regular bail arises out of Vaishali P.S. Case No.280 of 2024 registered for the offence punishable under sections 127(1), 115(2), 329(3), 303(2), 352, 352(1), 351(2), 3(5) of the B.N.S., 2023. Subsequently, section 103(1) of the B.N.S. 2023 was also added. 3.

The petitioners and others are accused of assaulting the deceased. The petitioner no.1 is said to have assaulted the deceased with a stick (phatta). The petitioner no.2 is order giver.

It has been submitted by learned counsel for

Patna High Court CR. MISC. No.38416 of 2025(2) dt.25-06-2025 2/2 the petitioner that no case under section 103(1) of the B.N.S., 2023 is made out in the facts of the case.

The date of occurrence is of 25.07.2024 but the deceased died on 05.08.2024 in course of treatment. The petitioners are in custody since 17.04.2025.

Considering the aforesaid facts, this bail application is allowed.

Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur / concerned Court below, in connection with Vaishali P.S. Case No.280 of 2024, subject to the condition that they will cooperate in the trial.
