1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Naubatpur Police Station Case No. 415 of 2024, dated 24.07.2024, disclosing offences under Sections 126(2)/127(2)/115(2)/118(1)/109/303(2)/3(4) of the Bhartiya Nyaya Sanhita.
3. The prosecution case, as per the First Information Report, is that on 23.07.2024, when the informant and his friend was helping an accident victim, the petitioners and some miscreants came running and the co-accused Vishi Manjhi
Patna High Court CR. MISC. No.37272 of 2025(4) dt.15-10-2025 2/3 assaulted informant's friend by means of Khanti on his head due to which he sustained injury. It has further been alleged that the petitioners snatched the mobile phone of the informant and his friend.
4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case merely on the basis of suspicion and previous enmity. The allegations against the petitioners are general and omnibus in nature. He further submits that from perusal of the First Information Report, it is evident that it was the co-accused Vishi Manjhi who gave Khanti blow on the head of the informant's friend, namely, Ranjan Tiwari, who sustained simple injury. He further submits that the allegation of snatching of mobile is just a super addition and ornamental. The petitioners have got no criminal antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the occurrence took place due to trivial issue, the allegations against the petitioners are general and omnibus in nature and the petitioners have got no criminal antecedent, I am inclined to grant the petitioners privilege of anticipatory

6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VI, Danapur, in connection with Naubatpur Police Station Case No. 415 of 2024, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
