Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 337, 338, 427, 188, 353, 295A, 120B, 436 of the Indian Penal Code.

The accusation is that a procession was going ahead to immerse the idol of goddess Saraswati when a mob pelted stones, resorted to fire and put the house on fire. It is submitted by learned counsel for the petitioners that accusation is against the mob and none received any fire arm injury nor any dwelling house was found to be burnt. Moreover co-accused have been granted bail vide Cr. Misc. Nos. 16579 of 2015 and 17711 of 2015. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

Nagar) P.S. Case No. 17 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
