This application for grant of regular bail arises out of Kudhani P.S. Case No. 201 of 2015, registered for the offence punishable under Sections 147, 148, 149, 447, 341, 342, 323, 324, 427, 436, 435, 504 of the Indian Penal Code, 13, 16, 18,
19. 20 of U.A.P. Act and 3 of Prevention of Damage to Public Property Act.
The petitioner is in custody since 28.08.2019. First Information Report was registered against unknown with the allegation that nearly 100 persons attacked the base camp of Gammon India Limited, assaulted its security guard with fists and slaps and set on fire some machineries, namely, four AMW Dumpers and Paver, one Bolero, one AMW TM, two Bolero
Patna High Court CR. MISC. No.36226 of 2020(2) dt.03-02-2021 2/2 Camper and one Bitumen Browser causing huge loss to the company. The petitioner's name surfaced during the course of investigation.
Learned counsel appearing on behalf of the petitioner has submitted that in similar circumstance, co-accused Ashesh Sahani and Bhola Sahani have been allowed regular bail by this Court by orders dated 15.09.2015 passed in Cr. Misc. No. 42185 of 2015 and dated 31.08.2015 passed in Cr. Misc. No. 36610 of 2015.
Considering the fact that there is no specific allegation against the petitioner and in similar circumstance others have been allowed regular bail, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, Muzaffarpur, in Kudhni P.S. Case No. 201 of 2015.
