JUSTICE RAJESH KUMAR VERMA ORAL ORDER 02-07-2026 Heard Mr.Dhananjay Kumar Pandey, learned counsel for the petitioner and Ms.Dr. Indiwar Kumari, learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Katoriya P.S.Case No.43 of 2026,FIR dated 09.02.2026 registered for the offences punishable under Sections 8,20(B),(ii)(A) of NDPS Act.

3. Recovery is of 445 Gms of Ganja.

4. Learned counsel for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.

5. Learned A.P.P. for the State has vehemently

Patna High Court CR. MISC. No.38042 of 2026(2) dt.02-07-2026 2/2 opposed the prayer for bail of the petitioner and submits that altogether 765 Gms of Ganja was recovered from the house of the petitioner and wife of the petitioner has been arrested from the place of occurrence.

6. Considering the aforesaid facts and recovery has been made from the house of the petitioner, hence, this is not a fit case for grant of anticipatory bail to the petitioner in connection with Katoriya P.S.Case No.43 of 2026 pending in the court of learned Additional Sessions Judge 1st -cum-Spl. Judge, NDPS, Banka.

7. Prayer is refused.
