JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Amdabad P.S. Case No. 56 of 2016 registered under Sections 363 and 366(A) of the Indian Penal Code, pending in the court of Judicial Magistrate Ist Class, Katihar.

The accusation is of kidnapping of minor daughter of informant by this petitioner with the help of other accused persons named in the F.I.R.

Learned counsel for the petitioner submits that in course of investigation, the victim-daughter of informant and informant reached at the Police Station and thereafter her statement, under Section 164 Cr.P.C., was recorded, in which, she has stated about her kidnapping by this petitioner covering her

Patna High Court Cr.Misc. No.3404 of 2017 (2) dt.10-02-2017 face and also keeping in Nepal and committing rape but she has not stated that how she returned from Nepal. Further submission is that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
