====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 21-06-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is in custody since 03.12.2018 in connection with Purani P.S. Case No. 169/2018 for the offence registered U/s 307/34 I.P.C. and U/s 27 Arms Act. Learned counsel for the petitioner submits that no specific role has been attributed against the present petitioner and one other similarly situated co-accused Sharda Nand Jha @ Bibhuti Jha @ Bibhuti has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No.28206 of 2019 vide order dated 30.04.2019.

It is submitted that the petitioner was made accused

Patna High Court CR. MISC. No.37499 of 2019(2) dt.21-06-2019 2/3 on suspicion and the name of the petitioner surfaced in the confessional statement of co-accused Manish Mandal. In the aforementioned facts and circumstances and in view of the fact that the case of the petitioner stands on similar footing to that of co-accused Sharda Nand Jha @ Bibhuti Jha @ Bibhuti, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Udakishunganj, District-Madhepura, in connection with Purani P.S. Case No. 169/2018, subject to the following conditions:

(1) Any blood relation of the petitioner will be the bailor.

(2) The petitioner shall not indulge himself in any similar offences till conclusion of the trial.

(3) The petitioner shall remain physically present in Court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned Court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself
