JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-05-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 24.6.2016 passed in Cr. Misc. No. 17390 of 2016, on the ground that the petitioner is suffering in custody since 13.1.2016, direction was given to conclude the trial within nine months but the trial has not been concluded and up till now only two prosecution witnesses have been examined. The learned A.P.P. opposes the prayer for bail by submitting that the deceased had stated the name before his death that the petitioner was the assailant.
In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer
Patna High Court Cr.Misc. No.19353 of 2017 (2) dt.10-05-2017 2/2 for bail of the petitioner stands rejected in connection with S.Tr. No. 55 of 2016, arising out of Jadia P.S. Case No. 37 of 2011 pending in the court of learned A.D.J. IIIrd, Supaul. However, the learned trial court is again directed to conclude the trial preferably within three months, failing which the petitioner, if at no fault, may be at liberty to renew his prayer for bail.
