The Petitioner seeks bail in Kankarbagh P.S.
Case No. 602 of 2015 instituted for the offence under Section(s) 394/120B of the Indian Penal Code.
It has been submitted on behalf of the petitioner that there is no recovery from the possession of this petitioner. The name of the petitioner has come during investigation on the basis of statement given by the informant after looking into the footage of C.C.T.V camera.
As per written report, one Sandeep Kumar and Ajay Kumar, the informant were going by motorcycle to deposit the money. On the way, one white colour Apache motorcycle
Patna High Court Cr.Misc. No.19113 of 2017 (3) dt.03-05-2017 2/2 came and the person sitting on the motorcycle snatched the bag and also fired causing fire arm injury to Sandeep Kumar. It has come in the order of learned Sessions Judge that in para 14 of the case diary the I.O. of the case has collected the C.C.T.V. footage of the camera installed near the P.O. and after showing the same the informant and other employees of the shop took the name of this petitioner. Besides this, there is no any other material available against this petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with Kankarbagh P.S. Case No.602 of 2015, subject to the conditions that both the bailors shall be the close relative of the petitioner.
