The petitioner apprehends his arrest in connection with Tarabari P.S. Case No. 26 of 2014 registered under Sections 304B/34 of the Indian Penal Code pending in the court of the J.M. Ist Class, Araria.
The accusation is of killing of Asha Devi, daughter of informant, by her father-in-law, mother-in-law, sister-inlaw(Gotni) and brother-in-law (Nandosi) due to non-fulfillment of demand of dowry by strangulation as the husband of deceased, Asha Devi, used to reside out side for livelihood of family. Admittedly, the deceased died within six months of her marriage at her Sasural house.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
