Petitioner seeks bail in a case registered for the offences punishable under Sections 317/369/34 of the Indian Penal Code, Section 23 of the Juvenile Justice Act, 2000 and Section 2(2) Human Trafficking Act.

According to FIR, the petitioner had sold her five years old child at the cost of Rs.3,00,000/- (rupees three lacs). However, soon after the sale, she demanded her child then the informant went to the police station complaining the aforesaid act. The petitioner admitted that she sold the child due to poverty and has already spent the said money. She wants her child. Submission of the petitioner is that the petitioner

Patna High Court Cr.Misc. No.14341 of 2017 (4) dt.15-05-2017 2/2 is a poor lady and the poverty had compelled to sell her child and she is in custody since 29.07.2016.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Rohtas at Sasaram/successor Court in connection with Sessions Trial No. 511 of 2016 arising out of Sasaram Town Police Station Case No. 857 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
