The petitioner has preferred this application for grant of regular bail in a case registered under sections 387 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the accused persons who were earlier made accused in a case relating to the murder of the informant's daughter are said to have come demanding a sum of Rs. 2 lacs which they had incurred in fighting the earlier case and on the informant refusing to give the same, the accused persons including the petitioner fired upon the informant. The shots missed the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case which would be evident from the contents of the FIR itself. It was on account of an earlier false case lodged by the informant against the petitioner for the murder of the informant's son. So far as the allegation in the instant case is concerned, no person has been injured. The petitioner is in custody since 13.6.2021 and there is

Having heard learned counsel for the parties and taking into consideration the facts of the case, no person having been injured on the side of the informant and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Pandarak P.S. Case no. 61 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Barh, Patna. (Partha Sarthy, J) Prakash/- U
