Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Bihpur P.S. Case No. 42 of 2023 dated 28.01.2023 registered for the offences punishable u/ss 147, 148, 149, 323, 324, 224, 225, 353 and 504 of the Indian Penal Code.

As per the prosecution case, on secret information, the petitioner is going towards his house with illegal liquor. The police raided the house of the petitioner and apprehended him.

It is further alleged that the petitioner along with the co-accused persons pelted stones over the police party due to which many police personnel were injured.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. No incriminating article has been recovered from the possession of the petitioner. He has further submitted that the petitioner did not cause any hindrance in discharging the official duties of police personnel. The petitioner is accused in four other criminal cases and he is on bail in all the cases as stated in para 3 of the bail petition. The petitioner is in custody since 13.02.2023.

Learned A.P.P. for the State has vehemently opposed the prayer of bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
