ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Sasaram(M) P.S. Case No.899 of 2014 for allegedly having committed the offence under Sections 147, 148, 149, 323, 337, 338, 353, 307 of the Indian Penal Code and Section 4/40 of the Bihar Mining Act.

Learned counsel for the petitioner submits that save and except the allegation that the petitioner had indulged in illegal mining, which has come to the fore on the statement made by the tractor owner, there is no further material so as to implicate the petitioner.

No.18358 of 2015 (3) dt.18-09-2015 2/2 Considering the aforementioned facts and circumstances and that the petitioner has absolutely no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas (Sasaram), in connection with Sasaram(M) P.S. Case No.899 of 2014,corresponding to G.R. No.1887 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
