Petitioner seeks bail in Begusarai Muffasil P.S. Case No. 333 of 2016 for the offence punishable under Sections 392 of the Indian Penal Code.

It has been submitted by the learned counsel for the petitioner that he has been made accused in Begusarai Town P.S. Case No. 469 of 2016, for recovery of one motorcycle on the basis of confession in that case. In the instant case mere suspicion has been raised against the petitioner. In the written report the petitioner is not named and no Test Identification Parade has been held in this cast till date, as it appears from the order of the learned Sessions Judge. It is also submitted that no incriminating article

Patna High Court Cr.Misc. No.19012 of 2017 (3) dt.10-05-2017 2/2 has been recovered from the possession of the petitioner. Considering the above facts and circumstances, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Begusarai Muffasil P.S. Case No. 333 of 2016 to the satisfaction of learned J.M. 1st Class, Begusarai subject to the condition that both the bailors should be close relatives of the petitioner.
