JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-07-2023 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in connection with Ghorasahan P.S. Case No. 422 of 2016 dated 26.10.2016 registered for the offences punishable u/s 406 and 420 of the Indian Penal Code.

As per the prosecution case, the informant came to the Punjab National Bank, Branch- Ghorasahan for depositing Rs. 45,000/- and the informant requested the petitioner to fill up the

Thereafter, the petitioner called a boy who filled up the deposit form of the informant and said to the informant that presently the link is not available in the bank and asked to go out with him. When the informant reached at the Railway Line, the said boy asked the informant to count his money but the informant gave the said amount to the said boy for counting and during that course the said boy fled away with his money i.e. 45,000/-.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The allegation of snatching the informant's money is against the unknown person. The petitioner is a bank employee in Punjab National Bank Branch- Ghorasahan, East Champaran. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 07.05.2023.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond

Patna High Court CR. MISC. No.39601 of 2023(2) dt.12-07-2023 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sikrahna at Daka, East Champaran in connection with Ghorasahan P.S. Case No. 422 of 2016.

The application stands allowed.
