JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/328/120B of the Indian Penal Code.
Wife of this petitioner died after sixteen years of her marriage. There is allegation of demand of dowry and torture for the same including physical assault.
Submission of the petitioner is that presumption of dowry death is not there and there is no eyewitness of the occurrence of murder.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.18343 of 2017 (2) dt.19-04-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui/Successor Court, in connection with Chandramandih P.S. Case No.28 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
