JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Alipur P.S. Case No. 12 of 2019 registered for the offences punishable under Sections 147, 341, 323, 353, 414, 504 and 506 of the Indian Penal Code.

As per FIR one tractor loaded with sand was intercepted by police and accused persons, including the petitioners came at the Police Station by a Scorpio vehicle and abused the police party.

Patna High Court CR. MISC. No.42992 of 2019(3) dt.17-10-2019 2/3 Submission of learned counsel for the petitioners is that there is general and omnibus allegation against the petitioners and no specific allegation has been attributed against any of them.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides and perused the record from which it appears that there is specific allegation against petitioner No.1. As such, prayer for anticipatory bail of petitioner No.1 is rejected. He may surrender and pray for regular bail.

So far petitioner Nos. 2 to 6 are concerned, in the facts and circumstances, let them, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Gaya, in connection with Alipur P.S. Case No. 12 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
