The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on the bolero vehicle in which the two petitioners were traveling being checked, it is stated that 270 litres of liquor was recovered. However, the driver managed to escape.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their possession. The petitioners have no concern either with the seized liquor or with the vehicle from which the same was
Patna High Court CR. MISC. No.49245 of 2021(2) dt.21-02-2022 2/2 recovered. They are in custody since 9.3.2021 and have no criminal antecedent.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent, the Court directs the above two petitioners to be enlarged on bail in connection with Excise Case no. 324 of 2021 (arising out of N.T.P.C. Khaira P.S. Case no. 11 of 2021) on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cumSpecial Judge, Excise, Aurangabad.
