The petitioners are in custody in connection with Excise Case No.476 of 2016 registered for an offence under Sections 30(a) & 37(b) of the Bihar Prohibition & Excise Act, 2016.
Both the petitioners were allegedly caught by the police while they were carrying 23 litres 400 ml. foreign liquor in their Scorpio.
Learned counsel for the petitioners submits that nothing has been recovered from the possession of the petitioners. There is no antecedent against any of the petitioners and they are in custody since 05.12.2016.
Patna High Court Cr.Misc. No.6024 of 2017 (2) dt.01-03-2017 2/2 Considering the nature of allegation, let the above named two petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Gopalganj in connection with Excise Case No.476 of 2016.
