Learned counsel for the petitioner submits that the candidature of the petitioner has been rejected only on the ground that mother of the petitioner has got a license of Public Distribution System Shop, whereas the fact is that the license in the name of mother of the petitioner was cancelled long back in the year 2013 and that would not have been any impediment in the petitioner's getting a license in accordance with law.
It is submitted that the petitioner is living separately
Patna High Court CWJC No.22914 of 2018(3) dt.27-07-2019 2/2 with his family and has every right to earn his livelihood. It is further submitted that the petitioner has represented before the District Magistrate, Purnia for consideration of his grievance vide Annexure '6' series, however, the same has remained pending so far without consideration.
Learned counsel for the State submits that in the given facts and circumstances of the case, it would only be just and proper that the District Magistrate Purnia be directed to consider the representation of the petitioner as contained in Annexure '6' series to the writ application and take and appropriate decision thereon.
In the given facts and circumstances of the case, this writ application is being disposed of with a direction to the District Magistrate, Purnia to consider the grievance of the petitioner, look into the representation as contained in Annexure '6' series, pass a reasoned order thereon within a period of 60 days from the date of receipt/production of a copy of this order.
