The petitioner seeks bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 167 of 2023 instituted for the offence under Sections 498(A), 376, 313, 504 & 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that mediation process started in between the petitioner and O.P. No.
Patna High Court CR. MISC. No.44559 of 2024(3) dt.12-11-2024 2/3 2, who happens to be husband and wife, has ended in amicable settlement in between both the spouses and presently they have started residing together and now there is no dispute in between them and in this regard, the report sent by the learned Mediator may be perused. It is submitted that petitioner is ready to keep his wife along with child with full honour and dignity. It is further submitted that the petitioner shall follow all the terms and conditions which have been fixed by the learned Mediator regarding which memorandum of agreement has been signed by both the spouses.

Learned counsel for the O.P. No.2 accepted the aforesaid factum of compromise and submits that O.P. No.2 shall also follow all the terms and conditions which have been fixed before the Mediator.

Considering the aforesaid facts and circumstances of the case and mainly the restoration of conjugal relation in between both the spouses, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Bettiah
