JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Riga P.S. Case No. 57 of 2016 instituted for the offence under Section 394/302 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that three miscreants intercepted the motorcycle of the informant and one of the miscreants fired shot on his chest and fled away after removing cash from the dikky of the motorcycle. Case diary has been called for.

From the case diary, it appears that the name of this petitioner has come in para 22 of the case diary by one spy. Besides such material, there is no material against this petitioner.

From the order of Sessions Judge, it appears that there is no allegation of any specific overt against this petitioner.

Considering the aforesaid facts and circumstances, the prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Sitamarhi, in connection with S. Tr. No. 506 of 2016, arising out of Riga P.S. Case No. 57 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
