2. The petitioner has prayed for bail in connection with Sitamarhi P.S. Case No. 499 of 2025 registered for the offence punishable under Sections 137(2) and 87 of the B.N.S., 2023.
3. The case of the prosecution, in short, is that on 05.07.2025, two minor girls one being the daughter of the informant and the other the daughter of Virendra Ram were missing. They were being searched, during which the informant came to know that one Sudhir had allegedly boarded the girls in his tempo. When questioned, Sudhir denied having boarded anyone in his vehicle. Thereafter, the informant also questioned
Patna High Court CR. MISC. No.38021 of 2026(2) dt.18-06-2026 2/3 the petitioner, who stated that he had no knowledge regarding the occurrence. It is alleged that the informant suspects that Sudhir and Deepak Kumar had kidnapped the two minor girls.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. During the course of the investigation, the victims have given their statement recorded under Sections 180 and 183 of the BNSS, wherein they have stated that one Sudhir has taken them away from their home, and with Deepak, one of the victims went to Hyderabad, whereas one of the victims stepped down from the train at another station. He further submits that from the statements of the two victims, it will transpire that both have narrated two stories, and the victim who has gone with Deepak, though she has stated that she stayed with Deepak in Hyderabad and Delhi, has not alleged any overt act against him.
She has stated that she returned for solemnizing marriage with Deepak. He further submits that the main thrust of the allegation is against Sudhir, who, according to the case of the prosecution, has taken away the minor girls. Thereafter, they went with this petitioner.

5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-VI-cum-Special Judge, POCSO Act, Sitamarhi in connection with Sitamarhi P.S. Case No. 499 of 2025.
