2. This is the second attempt on behalf of the petitioner for grant of bail in connection with S.Tr. No. 409 of 2024 arising out of Baniyapur P.S. Case No. 495 of 2023 registered for the offence under Section 302, 34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 02.04.2024 passed in Cr. Misc. No. 20666 of 2024.

4. As per the prosecution case, the petitioner is said to have participated in the murder of the deceased.

5. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner of killing the

Patna High Court CR. MISC. No.38820 of 2025(2) dt.18-07-2025 2/2 deceased. He further submits that last witness in this case was examined on 10.01.2025 and thereafter the trial of the case is pending for the examination of the I.O. and the Doctor. The petitioner is in custody since 24.11.2023.

6. Considering the delay in the trial and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge, XII, Saran at Chhapra/concerned Court below in connection with S.Tr. No. 409 of 2024 arising out of Baniyapur P.S. Case No. 495 of 2023.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
