ANJANA MISHRA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the case against the petitioner is false and fabricated and he has no role to play. It is further submitted that no specific role has been attributed to any members of the family of the petitioner. Admittedly, informant is not an eye-witness in the present case. Considering that there is only general and omnibus allegation
Patna High Court Cr.Misc. No.19207 of 2015 (3) dt.22-09-2015 P2/2 against this petitioner and that petitioner has no criminal antecedent, that let the petitioner, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Katoriya P.S. Case No. 22 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
