Mr. Upendra Pratap Singh, AC to SC 4 ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-10-2021 Heard the learned counsel for the petitioner and Sri Upendra Pratap Singh, learned AC to SC 4 appearing for the State.
The present petition has been filed for quashing the order dated 27.10.2018, passed by the Sub Divisional Officer, Areraj, whereby and whereunder the license of the P.D.S. shop of the petitioner bearing License no. 40 of 2016 has been cancelled. The petitioner has also sought for quashing of the appellate order dated 29.11.2019.
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to prefer a revision
Patna High Court CWJC No.992 of 2021(2) dt.29-10-2021 2/2 petition under Rule 32(vi) of Bihar Targeted Public Distribution System (Control) Order, 2016, against the aforesaid orders dated 27.10.2018 and 29.11.2019. The learned counsel for the respondent State has got no objection.
Accordingly, the present writ petition stands disposed off as not pressed, however with liberty to the petitioner to file appropriate revision petition before the concerned Divisional Commissioner and in case, such a revision petition is filed within a period of four weeks from today, the same shall be adjudicated on merits, without being impeded by the issue of limitation and a reasoned and a speaking order shall be passed, in accordance with law, within a period of eight weeks, thereafter.
