2. The petitioner seeks regular bail in connection with Gopalpur (Rangra) P.S. Case No. 596 of 2022, registered for the offence punishable under Sections 147, 148, 149, 323, 302, 504 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, firing took place between two sides in which one person was shot and killed.

4. Accused Mukesh Yadav and Hiralal Yadav shot at Raju Kumar thereafter Raju Kumar died. Petitioner is not the assailant of the deceased. He is in custody since 14.05.2023.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts as also period of

Patna High Court CR. MISC. No.39837 of 2023(2) dt.21-07-2023 2/2 custody, this application is allowed.

7. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Naugachia (Bhagalpur) in connection with Gopalpur (Rangra) P.S. Case No. 596 of 2022.
