Case No. 84 of 2019, arising out of Special Case No. 09 of 2019, disclosing offences under Sections 21 and 22 of the Narcotics Drugs and Psychotropic Substances Act and Sections 27 (b), 28 and 36 of the Drugs and Cosmetic Ac.

Allegation of recovery of 536 pieces each containing 100 ml of Dialex-DC Cough Syrup, which is prohibited drugs from the house of the petitioner.

Submission of the learned counsel for the petitioner is that the recovery was not from her house, rather from the outside of the house. She has falsely been implicated in this case. Further submission is that she is pregnant and her pregnancy is of eight months and she has no criminal

Having heard both sides, considering the above submissions, especially, the petitioner is a pregnant lady and she is on last stage of her pregnancy, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sessions Judge I/C, Araria, in connection with Jogbani P.S. Case No. 84 of 2019, arising out of Special Case No. 09 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
