In this case, the petitioners are seeking anticipatory bail in connection with Nautan P.S. Case No. 115 of 2018, registered for the offence under Section 302/34 of the Indian Penal Code.
Allegation has been made against the petitioners to have killed the daughter of the informant.
The petitioner no.1 is the father-in-law and petitioner no.2 is the mother-in-law of the deceased. From the case diary, it appears that the deceased was not keeping good relationship with her husband and in the previous night there
Patna High Court CR. MISC. No.37065 of 2019(3) dt.17-07-2019 2/2 was a quarrel in between the deceased and her husband and on that account, she committed suicide in the mid-night. Considering the aforesaid facts, let the abovenamed petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., XII, Siwan, in connection with Nautan P.S. Case no. 115 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
