Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366(A) of the I.P.C.
The minor daughter of the informant went of her own on 15.01.2015 and thereafter she went traceless. Subsequently one Shatrughan Sah saw going the daughter of the informant with Md. Faiyaz and 5/6 other persons in autorickshaw. When the informant made complaint to the family members of Md. Faiyaz then he was being abused and life threatening was given. The petitioners are uncle and married sister of Md. Faiyaz.
It is submitted by learned counsel for the petitioners that thrust of accusation is against Md. Faiyaz
Patna High Court Cr.Misc. No.9518 of 2015 (2) dt.20-04-2015 2/2 whereas parents of Md. Faiyaz have been granted bail by learned Court below.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 40 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
