JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sheyampur Bhatahan P.S. Case No. 2 of 2016 instituted for the offence under sections 188/406 and 409 of the Indian Penal Code. It has been submitted on behalf of the petitioner that there was some delay in construction work by this petitioner but vide Annexure-2 it is apparent that work has been completed and no work was pending against this petitioner.

There is allegation against this petitioner that work amounting to Rs. 1,48,931/- has not been completed by the petitioner while posted as Head Master of middle school Shyampur Pashchami.

The petitioner has enclosed Annexure-2 which is letter of District Programme Officer informing that work in the

Patna High Court Cr.Misc. No.12238 of 2017 (2) dt.23-03-2017 2/2 school has been completed. The name of school of this petitioner is mentioned at at sl.20. It is mentioned that work has been completed and no work is pending against the petitioner. It has further been submitted that petitioner has retired from service on 31.1.2017.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Sheyampur Bhatahan P.S. Case No. 02 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sheohar, subject to the conditions as laid down under Section 438(2) Cr.P.C.
