This is an application for bail in connection with Karakat P.S.Case No. 180 of 2016 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he is not named in the F.I.R and on the disclosure of co-accused, namely, Monu Khan, three stolen motorcycles have been recovered in front of garage of petitioner, however petitioner has nothing to do with the said recovery. Petitioner has no criminal antecedent and he is in custody since 30.12.2016. Moreover, the co-accused, on whose confession motorcycles were recovered has already been granted bail by this Court vide order dated 03.04.2017 passed in Criminal Miscellaneous No. 8514 of 2017. Heard learned APP also.

Having heard both sides and considering the above submission and also that other co-accused of this case has already been granted regular bail by this Court, as such, let the petitioner,

Patna High Court Cr.Misc. No.9566 of 2017 (2) dt.11-04-2017 2/2 above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, in connection with Karakat P.S.Case No. 180 of 2016, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
