JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mufassil P.S. Case No. 179 of 2018 for the offence under Sections 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that he was involved in theft of Tempoo. He further submits that the stolen Tempoo was recovered from the possession of co-accused Vikash Kumar @ Banti and not from the possession of the petitioner. The petitioner is in custody since 02.04.2019.
Considering the fact that nothing incriminating was recovered from the conscious possession of the petitioner, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with
Patna High Court CR. MISC. No.35278 of 2019(2) dt.29-05-2019 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Mufassil P.S. Case No. 179 of 2018.
