JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2017 The petitioners are in custody since 09.02.2017 in connection with Khagaria (Muffasil) P.S. Case No. 81 of 2017, registered for offences punishable under Sections 147, 148, 149, 326, 307, 504 and 506 of Indian Penal Code and Section 27 of Arms Act.

It has been submitted on behalf of the petitioners that there is allegation of indiscriminate firing against these petitioners and due to which several persons got injured, however, injuries on all the injured persons were found to be simple in nature. Petitioners have been in judicial custody since 09.02.2017. Learned counsel for the State and learned counsel for the informant opposed the prayer for bail. Leaned counsel for the informant submitted that due to the said indiscriminate firing

Patna High Court Cr.Misc. No.16122 of 2017 (2) dt.10-04-2017 2/2 several persons including informant have received gun shot injuries.

Having heard both sides, considering the aforementioned facts and circumstances and also that there is direct allegations against these petitioners for making indiscriminate firing, as such, I am not inclined to grant the petitioners the petitioners privilege of regular bail, it is accordingly rejected.
