The matter has been taken up through video conferencing.

Petitioner seeks regular bail in a case registered for the offence punishable under Section 363, 364(A), 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other FIR named accused persons kidnapped the minor daughter of the informant for the purpose of marriage. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that the victim in her statement u/s 164 of

Patna High Court CR. MISC. No.50310 of 2021(3) dt.13-01-2022 2/2 the Cr. P. C. made entire accusation against co-accused, Mantu Kumar. So far this petitioner is concerned, he is alleged to have accompanied co-accused, Mantu Kumar in kidnapping. Petitioner claims clean antecedent and is in custody since 14.06.2021 and investigation in this case is complete. Learned counsel appearing for the State and the informant opposed the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Sitamarhi in connection with Bajpatti PS case No.33/2021.
