The petitioner seeks bail in Parsa P.S. Case No. 31 of 2019, Trial No. 2227 of 2019, instituted for the offence under Section(s) 379, 420, 467, 468, 471 of the Indian Penal Code and Section 66 of I.T. Act.

It is alleged in the written report that informant on getting information that one person is moving near the SBI A.T.M. cabin in suspicious condition, he along with Police personnel reached there. On seeing the police party, one person tried to run way, but on chase, he was apprehended. He disclosed his name as Raj Kishore Kumar @ Faujdari (petitioner). On search, 11 ATM cards of different Banks, one Mobile phone and cash worth Rs.2,500/- have been recovered

Patna High Court CR. MISC. No.37346 of 2019(2) dt.20-06-2019 2/2 from his possession.

Counsel for the petitioner submits that petitioner is in custody since 8.2.2019. There is no specific allegation against the petitioner that he had committed any overt act by stealing ATM cards of other persons.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Saran at Chapra, in connection with Parsa P.S. Case No. 31 of 2019, Trial No. 2227 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
