=========================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 04-10-2017 Heard learned counsel for the petitioner and the State. From perusal of the pleading of parties, it appears that controversy is confined to only non-payment of Rs. 1,99,152 GPF and other amount with regard to certain period as set out in supplementary affidavit.
Counsel for the petitioner submits that apart from the aforesaid dues he has already received other pensionary benefits. In view of the aforesaid, this writ application is disposed of
Patna High Court CWJC No.2432 of 2016 dt.04-10-2017 2/2 with liberty to the petitioner to file detailed representation to the Director Panchayat Raj respondent no. 2 along with copy of this order enumerating the detailed claim of un-paid amount with supporting documents, if such representation is filed by the petitioner within period of one month from today, the respondent no. 2 Director Panchayat Raj shall consider the representation and pass speaking order on such representation and will ensure payment of the lawful amount to the petitioner within a further period of two months. In case the admitted monetary benefits are not paid to the petitioner within the time mentioned above, the un-paid G.P.F. amount and other dues will carry 9% interest w.e.f. 31st Jan, 2015 till the date of actual payment. With the aforesaid direction, the writ application stands disposed of.
