JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This is an application for grant of anticipatory bail in connection with Sherghati P.S. Case No. 252 of 2018, disclosing offences under Sections 341, 323, 376 and 506/34 of the Indian Penal Code.
Prosecution case is that husband of the informant died in the year 2012 and since then she is residing in her Sasural and petitioner committed rape upon her and also threatened her, thereafter, she remained there on assurance of marriage and petitioner continued sexual intercourse with her and when she asked petitioner to marry, he refused to marry with her. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted in order to pressurize the petitioner to marry her, which will appear from the case diary, as independent witness has stated before the
Patna High Court CR. MISC. No.35483 of 2019(3) dt.09-08-2019 2/2 police that she had gone to Delhi and thereafter, she went to her Maike and when she returned, she was pregnant and is making pressure upon the petitioner to marry with her, when he refused, the present case has been lodged.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Sherghati, in connection with Sherghati P.S. Case No. 252 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
