====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-11-2024 Heard learned counsel for the petitioner and learned counsel for the respondent/State.

This is an application for issuance of direction to the concerned respondent(s) to pay the total amount of arrears of salary to the tune of Rs. 11,35,012/- for the period from 17.06.1994 to 31.10.2011, minus the amount of Rs. 4,54,334/- which has been paid by the respondent University, out of the

Patna High Court CWJC No.9616 of 2023(2) dt.28-11-2024 2/3 aforesaid amount and the petitioner also prays to direct the respondents to pay the aforesaid difference amount along with interest at the rate of 12% per annum, from the date the same beame admissible to the petitioner till actual date of payment.

Learned counsel for the petitioner submits that in this regard, petitioner has filed representation before the respondent no. 5/Finance Officer, B.R.A.Bihar University, Muzaffarpur (Annexure P/1), but till date no action has been taken. Accordingly, he requests for disposal of the writ petition granting liberty to the petitioner to file fresh representation annexing relevant documents before the concerned respondent within a period of six weeks from today.

4. In view of nature of grievance, the writ petition is disposed of with liberty, as indicated above. If such representation is filed within stipulated time, the concerned respondent(s) shall examine the same and pass a reasoned & speaking order after hearing the parties in accordance with law within a period of six months from the date of filing of such representation. Upon examination of the claim of the petitioner, if any admissible dues is found payable to the petitioner, the same shall be paid to the petitioner within a period of six months from the date of passing of order by the concerned
