Petitioner seeks bail in connection with Arwal P.S. Case No. 69 of 2016 registered for the offences punishable under Sections 420, 406, 120B of the Indian Penal Code. Allegedly, co-accused Shambhu Nath Singh, Rekha Devi and Vineeta Devi went in the shop of the informant and after showing an old coin took Rs. 4 lakhs from the informant assuring him that the value of this coin is Rs. 30 lakhs and they will get it sold later on for Rs. 30 lakhs. It is alleged that the petitioner was standing outside the said shop.
Submission is of false implication and that Shmabhu Nath Singh has already been allowed bail by the learned court below itself and the petitioner is suffering in custody since 11.12.2016 having no concern with the alleged cheating. The petitioner has

No.6298 of 2017 (2) dt.16-03-2017 got no connection with those co-accused and only on the basis of statement of co-accused Shambhu Nath Singh the petitioner has been made named accused in this case and as such the petitioner deserves sympathetic consideration. Co-accused Vineeta Devi has also been allowed bail by the impugned order itself. Learned APP submits that the petitioner was also involved as he was watching from outside the shop.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 69 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
