2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Amarpur P.S. Case No. 94 of 2024, lodged on 10.02.2024, under Sections 341/323/307/379/504/506/34 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Banka.
3. As per the prosecution, the FIR has been lodged against two named accused persons including the present
Patna High Court CR. MISC. No.37970 of 2026(2) dt.17-06-2026 2/3 petitioner. Allegation of assault with rod on the head of the informant is against petitioner Pappu Yadav.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner has got no criminal antecedent. He submits that the petitioner and the informant both are co-villager and next door neighbour. He submits that the dispute between the petitioner and informant arose merely due to monetary transactions relating to monthly house hold goods purchased from the informant's shop. Counsel submits that petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is direct allegation of assault with rod on the head of the informant is against the petitioner.
6. Considering the direct allegation of assault against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail of petitioner is hereby refused. However, in the event of surrender of the petitioner within four weeks from today, the prayer for regular bail shall be considered on
Patna High Court CR. MISC. No.37970 of 2026(2) dt.17-06-2026 3/3 the same day without being prejudiced by the order of this Court.
