2. The petitioner seeks bail in connection with Sheohar P.S. Case No. 201 of 2017, instituted for the offences punishable under Sections 384, 386, 504, 506 and 34 of the Indian Penal Code.
3. The prosecution case, in short, is that a call was made from the mobile number of co-accused person to the informant for rangdari of Rs. 1,00,000/-. It is further alleged that the clerk of the informant has paid Rs. 25,000/- each to certain persons whose names are described in the FIR. The informant has also alleged that he has come to know that certain persons named in the FIR had made a group with fake MCC name and they are collecting rangdari from the local

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that name of the petitioner has transpired in this case on the basis of confessional statement made by co-accused, namely, Devendra Ram and the same has got no evidentiary value. It is further submitted that no specific allegation has been levelled against the petitioner rather the same is general and omnibus in nature. The petitioner is in custody since 12.11.2024 and has got five criminal antecedents in which he is on bail. Learned counsel for the petitioner further submits that other coaccused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 24.08.2022 passed in Cr. Misc. No. 30696 of 2022.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail
Patna High Court CR. MISC. No.38021 of 2025(3) dt.20-08-2025 3/3 to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sheohar P.S. Case No. 201 of 2017.
