JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in N.D.P.S. Case No. 26 of 2016 arising out of Excise Case No. 8 of 2016 instituted for the offence under Section 20 (b) of Narcotic Drugs & Psychotropic Substance Act.
It is alleged that 10 grams of Ganja has been recovered from the shop (Gumti) of the petitioner.
It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent.
The seizure list has been prepared but it does not bear the signature of the petitioner. The seized article is below the small quantity as defined in Section 17 (a) of N.D.P.S Act. Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.11089 of 2017 (2) dt.18-03-2017 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge/Special Judge, East Champaran at Motihari, in connection with N.D.P.S. Case No. 26 of 2016 arising out of Excise Case No. 8 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
