The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 324, 307, 337, 338, 353 of the Indian Penal Code and Sections 25(1-b)/27 of the Arms Act. Prosecution case, in short, is that when the informant along with others police party had gone for measurement of land, the accused persons variously armed obstructed in official duty and also pelted bricks and stones on them, due to which they got injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.03.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.36788 of 2019(2) dt.25-06-2019 2/2 against the petitioner. F.I.R. was instituted against 34 persons along with other unknown perosns. General and omnibus allegation has been made. No specific overt act has been alleged against the petitioner. Other co-accused have been granted bail vide Annexure 2 series to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bettiah Muffasil P.S. case No.667 of 2018.
