====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 19-06-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Special Case No. 3267 of 2019 arising out of Khusrupur P.S. Case No. 96 of 2019 instituted for the offence under Section(s) 30(a) and 38 of Bihar Prohibition Excise Act, 2016.

It is alleged in the written report that Police recovered 15.750 litres of Mahua liquor from Tata Indigo Car. One person found standing near the car was arrested by the Police. He disclosed his name as Sohan Kumar. It is further alleged that on the basis of confessional statement of Sohan Kumar, Police conducted raid in the house of Akhilesh Das and

Patna High Court CR. MISC. No.36942 of 2019(2) dt.19-06-2019 2/2 recovered 164.200 litres of Mahua liquor.

Counsel for the petitioners submits that petitioner No. 1 is wife of Akhilesh Das. Petitioner No. 2 has no concern with the recovery of alleged illicit liquor.

Petitioners are in custody since 25.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Spl. Judge, Excise, Patna, in connection with Special Case No. 3267 of 2019 arising out of Khusrupur P.S. Case No. 96 of 2019, subject to the condition that both the bailors will be close relatives of the petitioners.
