The petitioner apprehends his arrest in connection with Excise Case No. 245C3 Ex/2016 registered under Sections 30(a), 30 (d) of the Bihar Excise and Prohibition Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. He has no criminal antecedent. Nothing has been recovered from the conscious possession of the petitioner. Further submission is that on perusal of seizure list, it appears that the recovery has been made from the joint house of accused persons.

Having considered the facts and circumstances of the

No.36329 of 2019(3) dt.25-06-2019 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge-cum-Special Judge, Excise, Biharsharif, Nalanda in connection with Excise Case No. 245C3Ex/2016, subject to the condition as laid down under Section 438(2) of the Cr.
