The petitioner seeks bail in connection with Ghosi P.S. Case No.81 of 2014 registered under Sections 302 and 307/34 of the Indian Penal Code besides Section 27 of the Arms Act. Learned counsel appearing on behalf of the petitioner submits that on the basis of information given by the injured Ramji Thakur to the informant, the present case was lodged by the informant against unknown. Later on, in course of investigation, after five days of the occurrence, the injured Ramji Thakur disclosed the name of five persons including the petitioner to the effect that they had come with firearms and Krishna Yadav caused
Patna High Court Cr.Misc. No.20071 of 2017 (3) dt.29-06-2017 2/2 firearm injury to him and the deceased Parshuram Das. The injured Ramji Thakur has not attributed any allegation against the petitioner. The petitioner having no criminal antecedent is in custody since 06.02.2017. Further submission is that the coaccused Krishna Yadav has already been granted bail by a Bench of this Court vide order dated 17.05.2017 passed in Criminal Misc. No.19061 of 2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Ghosi P.S. Case No.81 of 2014.
