In this case, the petitioner is seeking anticipatory bail in connection with Rajgir P.S. Case No.299 of 2018, registered for the offence punishable under Sections 341, 323, 366(A), 376 and 34 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have kidnapped the victim girl and took her to Delhi by train and co-accused Manish Kumar kept her in a room and committed rape upon her till two days. The victim girl in her statement under Section 164 Cr.P.C. has supported the allegation against the petitioner.

Looking to the nature of allegation, this Court is

Patna High Court CR. MISC. No.36792 of 2019(2) dt.17-06-2019 2/2 not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court. (Shivaji Pandey, J) V.K.Pandey/- U T
